The authorities denied statelesness status to the applicant, holding that he could have applied for both Ghanaian and Malian nationality, countries the applicant had links with.The Court of Florence overturned this decision, holding that the standard of proof must be lower and similar to that used to identify a "foreigner eligible for international protection" under Italian law. The lower standard of proof means the Court can recognise statelessness status even when no full evidence of facts is submitted, provided that the applicant has used his reasonable endeavours to substantiate his application, could provide sufficient justification for the absence of significant facts, has submitted plausible and consistent statements, has lodged his application as soon as practicable or has had a good reason for delay, and can be regarded as a credible person.

Article 25 of the French Civil Code provides that an individual may be stripped of their French nationality where, inter alia, it was acquired by naturalization and where the individual has been convicted of a crime that constituted an attack on the fundamental interests of France or an act of terrorism. Deprivation of French nationality is not allowed where it would render the individual stateless. The applicant was deprived of his French nationality, which he had acquired by naturalization, following a decision of the Paris Criminal Court (Tribunal de Grande Instance de Paris) convicting him for his participation in an association of criminals with a view to preparing an act of terrorism. That court found that he had joined a terrorist group and participated in training and armed operations of that group. The Council of State (Conseil d’État) upheld the decree of deprivation of nationality because the applicant held Algerian nationality since birth and could not be deprived of it since the Algerian code of nationality only authorises the deprivation of nationality for persons who have acquired it after birth. Therefore, the loss of French nationality would not render him stateless and was thus not illegal under French law. The Council of State also ruled on the proportionality of the decree with regard to the European Convention on Human Rights and found that, given the seriousness of the crimes committed by the applicant, the challenged decree did not disproportionately infringe the right to respect for his private life guaranteed by Article 8 of the ECHR.

The applicant is from Western Sahara and identifies as a Sahrawi, a territory occupied by Morocco. Having fled to France, he  argued that he should qualify as a stateless person even though his birth certificate indicates that he has Moroccan nationality. He argued that this matter should be referred to the CJEU for a preliminary ruling.

An Austrian national by birth transferred his residence to Germany and naturalised as a German national. The naturalisation in Germany had the effect, in accordance with Austrian law, of causing him to lose his Austrian nationality. The German authorities later withdrew the naturalisation with retroactive effect, on the grounds that the applicant had not disclosed that he was the subject of a criminal investigation in Austria on account of suspected serious fraud, and that he had thus obtained German nationality by deception. The Court held that it is not contrary to EU law for a Member State to withdraw nationality obtained by deception, even if it results in losing EU citizenship, so long as the decision observes the principle of proportionality. Observance of the principle of proportionality requires the person concerned to be afforded a reasonable period of time in order to try to recover the nationality of their Member State of origin.

The appellant is a former USSR national, living in Latvia. The case is concerned with whether Latvia’s refusal of citizenship to a person who had criticised the Government, constituted a punitive measure in violation of that individual’s rights to freedom of expression under Article 10 and freedom of assembly and association under Article 11. The Court found no violation of articles 10 and 11 as the denial of citizenship did not affect the appellant’s relevant rights. Contrary, it highlighted that there is no “right to a nationality” under the Convention, and no provision of Latvian law indicates the appellant’s right to Latvian citizenship.

The applicant of Roma origin was denied a residence permit to the Netherlands on the basis of the applicant’s husband failing to meet the requirements under domestic immigration rules and because of the applicant’s multiple convictions. The Court held the Contracting State had struck a fair balance between the applicant’s Article 8 rights and its own interests in regulating its immigration.

The appellant faced deportation even though her stateless status was de facto recognised. For this reason, the appellant requested that the Justice of Peace’s decision be overturned, and for her stateless status to be recognised. The Supreme Court recognised the applicant’s stateless status and overruled the Justice of Peace’s decision.

The applicant is a child who was born in Ireland to a Cameroonian mother and a Ghanaian father, it was asserted that the child was stateless. The Refugee Appeal Tribunal denied the child applicant refugee status and the applicant requested a judicial review of the tribunal’s decision. The application centred around the tribunals alleged wrongful reliance on the applicant’s right to acquire citizenship in Ghana and Cameroon. The application for judicial review was ultimately unsuccessful.

The applicant brought an appeal challenging the constitutionality of s.19 of the Irish Nationality and Citizenship Act 1956, which governs the procedure by which revocation of naturalisation is determined. The fact that the Minister initiated the revocation process, appointed the committee charged with conducting the inquiry and then reached the final decision, was unconstitutional according to the applicant, as it breached the right to fair procedures. The Court held that s.19 was unconstitutional because it did not provide the procedural safeguards required to meet the high threshold of natural justice applicable to a person facing such severe consequences, i.e. revocation of naturalisation.

This case concerned an appeal as to whether an applicant for subsidiary protection may be considered both as a national of a third country and a stateless person simultaneously under the European Communities (Eligibility for Protection) Regulations 2006 and the Qualification Directive. The Court held that a person who is a national of a state is not a stateless person and that such state or country is his country of origin in relation to which his application must be primarily decided.

The applicant appplicant was born in Russia and renounced his Russian nationality in 2000. He applied for a statelessness status in Luxembourg in 2008, but it was discovered that he had applied for asylum status in the Netherlands in 2006, which was rejected, so Luxembourg transferred the applicant to the Netherlands under the Dublin regulation. The applicant returned several times to Luxembourg and was sent back to the Netherlands. He made a repeated application for statelessness status in 2014, where the courts accepted his argument that statelessness status determination doesn't fall within the scope of the Dublin regulations, and the court also accepted that his voluntary renunciation of Russian nationality does not exclude him from protection under the 1954 Convention.

The applicant is a Palestinian from Syria, who holds a refugee status in Hungary. He also applied for a recognition as a stateless person in Luxembourg. The Court found that the 1954 Statelessness Convention was conceived as complementary to the Refugee Convention. Since the applicant as a refugee in Hungary received at least as good a protection as a Palestinian in an UNRWA protected territory, the latter category being explicitly excluded from the protection scope of the 1954 Convention, the applicant did not qualify for the recognition of a statelessness status in Luxembourg.

The applicant received asylum status as a stateless Palestinian, but his request to register his statelessness in the municipal civil records was rejected due to lack of evidence. He has an original UNRWA document and an ID from Lebanon, but they were considered insufficient proof of identity as well as of statelessness. The applicant complained that inability to affirm his statelessness violates his identity rights under article 8 ECHR, as well as his rights as a stateless person under EU law, both of which arguments didn't succeed.

The Court of Cassation ruled that a stateless person could be deported only in the case provided for in Article 31 of the 1954 Convention, i.e. on the basis on national security or public order, and not on the grounds of their irregular presence on the territory. Article 31 is applicable, by analogy, to de facto statelessness and/or pending a formal statelessness determination procedure, if the condition of stateless had already emerged from the information and documentation provided by the competent authorities (of the Italian state or of the country of origin). The Court recognised the de facto stateless status of the applicant and repealed the deportation orders.

An Egyptian national, who resided in Malta and acquired Maltese nationality, was granted authorisation to renounce his Egyptian nationality as he could not hold dual nationality while in Malta. He was deprived of his Maltese nationality years later, following a decision that found that he had obtained his Maltese nationality from his first marriage through fraud. The Court found that there was no violation of Article 8 and held that the decision to deprive the applicant of his Maltese nationality did not adversely affect him.
